STUCTURING OF THE COLLECTIVE MARK

What is a collective trademark?

A collective trademark is a mark used by members of a collective to indicate group membership or to identify and distinguish products and services of members from those of non-members.

Why a collective trademark?

    • Generally, the use of intellectual property tools aims to the protection of the owner and users of the mark and the promotion of products
      • The Collective marks aim also to:
      • Share a common strategy for the targeted product(s)
      • Have a common governance
      • Define common rules to be respected by the collective
  • Protect the different groups of professionals

What benefits for very small, small and medium companies?

    • Have visibility of the product(s) and/or territory concerned
    • Define the outline of the products therefore offer a guarantee for consumers
    • Collective marketing to enhance the reputation that will attract consumers

Creation or identification of a group carrying the brand

  • Define the rules for products and the use of the mark
  • Define the common marketing and communication strategy
  • Granting of rights to use the collective mark for members with the possibility of using their own trademarks with the collective mark

Our experience:

Collective Brand Project

  • The World Intellectual Property Organization (WIPO), approved in 2019 a Development Agenda project on “the registration of collective marks of local companies as a cross-cutting issue of economic development”
  • This project aims to develop a support system and capacity building to facilitate the registration of collective marks of local companies in four countries: Tunisia, Bolivia, Portugal and Brazil.
  • The objective of this project is to facilitate the registration of collective marks of local companies in Tunisia as an axis of economic development.
  • The project team, of which our expert Ms. Wafa Ben Hamida is a member, works with local authorities and institutions, in particular the National Institute for Standardization and Industrial Property (INNORPI), in the implementation of the project, with the prospect of being able to contribute to its sustainability.

Project phases:

  • Creation of a collective
  • Creation of the collective brand
  • Establishment of the rules for the use of the collective brand and the specifications if necessary
  • Registration of the collective brand
